Introduction

Welcome to Radiology Cafe, an online resource, community and revision website for the use of health professionals and medical students.  By using this site, whether as a registered user or non-registered user, you are indicating that you accept these Terms of Service (also called Terms and Conditions / Terms of Use) and agree to abide by them.  Please ensure that you read through them thoroughly and understand them prior to using the Radiology Cafe website.

These Terms of service apply to the use of the services provided by Radiology Cafe.  If you do not agree to be bound by these Terms of Service do not use this website.

 

Usage of Website

To the extent that our website and the information and services on our website are provided free of charge, we will not be liable for any loss or damage of any nature.  If you use or attempt to use the service for purposes other than personal individual revision, your account will be terminated and you will be subject to damages and other penalties, including criminal prosecution where available.  Examples of prohibited uses include, but are not limited to, copying questions, answers or notes or attempting to tamper, hack, modify or otherwise use the website in any way that is likely to compromise or corrupt the security or functionality of the services provided by Radiology Cafe.

We reserve the right to restrict access to areas of our website, or indeed our whole website, at our discretion; to discontinue or alter any or all of our website services, and to stop publishing our website, at any time at our sole discretion without notice or explanation.  You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on our website.

Whilst we will endeavour to ensure that the website availability is not interrupted, access may be restricted from time to time to allow for site maintenance or upgrade.  Website availability may also be interrupted due to technical problems.  Again we will always try to resolve these as soon as possible but we cannot accept responsibility for any loss or damages that may result from this.

When registering for an account on Radiology Cafe and choosing a username, please do not choose a username that may infringe trademarks (for example usernames like Google, Amazon, Facebook, and so on).  Radiology Cafe reserves the right to delete or modify a user account at any time.

 

Copyright

The Radiology Cafe site is copyright protected and it’s content, design, layout, databases or graphics shall not be reproduced, stored in any form or by any means including but not limited to electronic, paper, mechanical, photocopying, recording, or broadcasting.  Unless you own or control the relevant rights in the material, you must not:

  1. republish material from our website (including republication on another website);
  2. sell, rent or sub-license material from our website;
  3. show any material from our website in public;
  4. exploit material from our website for a commercial purpose;
  5. or redistribute material from our website.

You may only use the material available for your own personal non-commercial home use provided that it is not changed and copyright notices remain; Radiology Cafe retains the intellectual property rights on all material from their website.  You shall not create any derivative work or make any other adaptation, without our prior written consent.

If you use or attempt to use the service for purposes other than personal individual non-commercial home use, including but not limited to copying questions, copying answers, copying notes, tampering, hacking, modifying or otherwise corrupting the security or functionality of the service provided by Radiology Cafe, your account will be terminated and you will be subject to damages and other penalties, including criminal prosecution where available.

All rights not explicitly granted in these Terms of service or in any written licence remain reserved.

 

Use of Radiology Cafe logo and branding

Use of the Radiology Cafe logo and branding are goverened by our Brand Guidelines and Radiology Cafe Trademark Guidelines which can be found on the Radiology Cafe Brand Resources page.

 

 

Article Submission Terms & Conditions

These terms and conditions apply to you if you have submitted content to Radiology Cafe via an email address or contact forms.

  1. By submitting an article for publication on Radiology Cafe, you agree that any articles, photos/images and any other content you submit is your original content or properly licensed content that you have the express right and permission to license to us, does not infringe or violate any law, rule or regulation or the rights or intellectual property rights of any person or entity (or encourage anyone else to do so), inaccurate or inflammatory; and is not obscene, defamatory, threatening, pornographic, harassing, hateful, racially or ethnically offensive.
  2. Articles are published on Radiology Cafe at the discretion of the editor.  The editor holds the right to edit any article submitted, to improve readability, and may change the content of it to reflect the needs of the website.  The editor holds the right to change article headings, content and images within the article, without prior notice to the author.
  3. Radiology Cafe retains the right not to publish any content submitted to us, without need for justification or explanation.  We retain the right to use (online or otherwise) content submitted to us after initial publication without notification of the copyright owner.
  4. All authors with published articles will be credited for their work at the top or bottom of the article.
  5. By submitting an article to Radiology Cafe you agree to notify us in writing if you become aware of any claim that the website or any of the contents of the website infringes any copyright, trade mark, or other contractual, statutory or common law rights of any party.
  6. If you violate any of the terms (above), which you agree to by sending content to us via our contact form or email, or we receive an inquiry or complaint about your post, you agree that you are responsible, and you agree to indemnify and hold harmless Radiology Cafe for all resulting claims and liabilities.

Articles published on the Radiology Cafe website may not reflect the views of the Radiology Cafe team.

 

Subscription

The price you pay for any chargeable Radiology Cafe services is indicated on the website.  Subscribers are required to make payments in pounds sterling.  If you are paying from a non-UK pound sterling account then your card provider will calculate the exchange rate of your transaction.

Please note that if you wish to cancel any subscription that you have purchased after our contract comes into effect, you may be subject to a cancellation charge.  You hereby agree that due to the nature of the service provided by Radiology Cafe that a refund of your subscription is not permitted once the service has started.

Accounts are personal to the subscriber and for their sole and non-commercial home use.  Passwords and other log on details must not be passed to others.  We have the right to take action if this requirement is not adhered to including, but not limited to, immediate termination of your subscription/user account.  You undertake to us that all the details you give to us while using the website are correct, in particular that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the service.

 

Limitation of liability

Whilst reasonable care is taken to ensure the accuracy of information on this site, to the fullest extent permitted by law the material and information displayed on our website is provided without any guarantees, conditions or warranties as to the correctness, accuracy, reliability, usefulness or otherwise of information provided.  Medical knowledge is constantly evolving and to the fullest extent permitted by law, Radiology Cafe does not accept any responsibility or legal liability for any errors or the misuse or misapplication of material on the website.

Radiology Cafe shall not be liable to users of this site by reason of any representation or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract for any loss of profit or any direct or indirect, special or consequential loss, damage, costs, expenses or other claims of any kind (whether caused by the negligence of Radiology Cafe, its servants or agents or otherwise) which arise out of or in connection with the revision notes/questions and other information available on this website except as expressly provided in these conditions.

Radiology Cafe shall not be liable to users or others or be deemed in breach of contract by reason of any delay or failure to perform any of its obligations in relation to the website if this was due to any cause beyond the reasonable control of Radiology Cafe.

In no event shall Radiology Cafe’s total liability to any user for all damages, losses, and other causes of action (whether in contract or not) exceed the amount paid to Radiology Cafe for use of this site.  The maximum liability for any claim from a user shall not exceed the current subscription fee which has been paid.

The content on this site is for information only and is not to be taken as individual advice and does not constitute medical advice.  Radiology Cafe cannot provide medical advice by email communication.  It is always advisable to discuss any medical matters with your GP or hospital consultant in the first instance.

 

Third party links and content

Radiology Cafe occasionally displays links to and content from third-party sources of information (such as The Royal College of Radiologists).  These have their own independent privacy policies and we have no responsibility or liability for their content accuracy.  The inclusion of a link does not imply endorsement or approval of the site or its contents which are independent of Radiology Cafe and over which we have no control.  As such we can accept no responsibility for the contents or any loss or damages that may result from using these external sites.

Project™ or Open Source Matters.  The Joomla!® name and logo is used under a limited license granted by Open Source Matters the trademark holder in the United States and other countries.

 

Medical images

All medical images on the site are fully anonymised and use of these images is in accordance with paragraphs 10-12 of the General Medical Council’s guidance document entitled Making and using visual and audio recordings of patients.  The mock FRCR exams were created by our team and are all original content designed to be representative of the Royal College of Radiologist’s FRCR examination.  The questions are not taken from other sources or re-created from previous FRCR examinations.   We fully adhere to the Royal College of Radiologists’ Examinations Misconduct Policy.  The downloading and saving of these images is strictly prohibited.

 

Privacy

All personal data collected by Radiology Cafe is governed by our Privacy policy.  By using this site you consent to use of personal data in accordance with the privacy policy.

 

Law governing Terms of Service

These Terms of service shall be governed and construed exclusively by the laws of England and Wales.  However we retain the right to bring proceedings for a breach of these Terms of service in any relevant country.  These Terms of service do not otherwise affect your statutory rights.

 

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms of service at any time.  We will post those changes on this page and update the Terms of service modification date below.  If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.  What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our website or services after those revisions become effective, you agree to be bound by the revised terms.  If you do not agree to the new terms, please stop using the website.
